Welcome to VertexVPN. These Terms of Service ("Terms") govern your use of the VertexVPN Android application ("the App") and any related services provided by VertexVPN ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using VertexVPN, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 13 years of age to use VertexVPN. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your Android device(s) for personal, non-commercial purposes.

4. Acceptable Use

You agree to use VertexVPN only for lawful purposes. You shall not:

  • Use the App for any illegal activity or to facilitate the commission of any crime
  • Use the App to access, transmit, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
  • Use the App to infringe upon the intellectual property rights or privacy rights of others
  • Use the App to distribute malware, viruses, or any other malicious code
  • Use the App to engage in unauthorized access to computer systems, networks, or accounts
  • Attempt to reverse-engineer, decompile, or disassemble the App or any part thereof
  • Use the App to circumvent or interfere with any security measures or access controls
  • Resell, redistribute, or sublicense access to the App without our written consent
  • Use the App in any jurisdiction where its use is prohibited by law

5. VPN Service Description

VertexVPN provides a virtual private network (VPN) service that encrypts your internet traffic and routes it through a server of your choice. The App supports VLESS-compatible protocols and allows you to import server configurations via links or QR codes.

VertexVPN acts solely as a tool to establish encrypted connections. We are not responsible for the content, availability, or policies of any third-party servers you connect to through the App.

6. User-Configured Servers

VertexVPN allows you to add and configure your own VPN servers. You are solely responsible for:

  • The legality and appropriateness of any server you configure
  • Maintaining the security credentials of your server configurations
  • Any consequences arising from your use of third-party servers

Server configuration data is stored locally on your device and encrypted. We do not have access to your server configurations.

7. Intellectual Property

The App, including its design, graphics, code, trademarks, and all related intellectual property, is owned by VertexVPN or its licensors. These Terms do not grant you any rights to our intellectual property beyond the limited license described in Section 3.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the App will be uninterrupted, error-free, or completely secure
  • Warranties regarding the accuracy, reliability, or availability of any VPN connection or server

No advice or information obtained from us shall create any warranty not expressly stated in these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, VertexVPN and its officers, directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, goodwill, or other intangible losses
  • Any damages arising from your use or inability to use the App
  • Any damages arising from unauthorized access to or use of our services
  • Any interruption, suspension, or termination of the App or VPN connections
  • Any third-party conduct or content accessed through the App

10. Indemnification

You agree to indemnify, defend, and hold harmless VertexVPN and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you transmit or cause to be transmitted through the App

11. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without prior notice, if we determine that you have violated these Terms or engaged in conduct that we deem harmful to other users, us, or third parties.

Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall remain in effect.

12. Modifications to the App and Terms

We reserve the right to modify, update, or discontinue the App (or any part thereof) at any time, with or without notice. We may also revise these Terms periodically. Continued use of the App after changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms regularly for any updates.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts of the governing jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VertexVPN regarding your use of the App, and supersede all prior agreements, representations, and understandings.
